
INTRODUCTION
In the recent times, modern technological development has redefined the concept of learning and teaching. Advance tool of pedagogy in legal academia has increased the challenges before law teachers. Changing dynamics of law and information technology has moved the academics and requires command over contemporary legal issues along with traditional principles. Therefore, every teacher needs to continuously upgrade himself/herself by engaging in research. The FDP deals with the contemporary legal issues and focuses on enhancement of the law research and development skills of the faculty. The Programme was attended by around 80 faculty members of different departments of JEMTEC as well as other academic institutes.
OBJECTIVS OF FDP
- To provide in depth understanding about pedagogy of research and teaching in the domain of law.
- To provide understanding about various methods of research and to make them aware about the role of legal research in the development of law.
- To have an understanding about research ethics and reporting of research findings.
- To equip them with use of computer, internet for academic research.
- To enhance research capability of faculty members in different methods of research
REPORT
DAY I (16.12.2019)
A Seven days Faculty Development Program (FDP-2019) on “Law Research and Development” was organized by JEMTEC School of Law, Greater Noida campus and was inaugurated in the august presence of Prof. (Dr.) Afzal Wani, and Prof. (Dr.) Pallavi Gupta, HOD, School of Law, today, i.e 16/12/2019. The programme will continue till 22/12/2019. There was first a lamp lighting ceremony and then a welcome speech was given by our esteemed HOD.
Academicians from several Universities/Colleges like Galgotias , Amity, DME, CPJ, Shyam Lal College etc. participated in the event. There was full-fledged participation of the faculty members of JMETEC School of Law also.
The chief guest Prof. (Dr.) Afzal Wani has 30 years of experience in law teaching and research. In the same time he has donned various caps and served in various positions. He has been a member of Law Commission of India from 2009 to 2012. He has also served as the Dean of School of Law and Legal Studies of GGSIP University Law.
He talked about how there are certain problems which are faced by everyone universally. He emphasized on the point that although in today’s world continuous updation of studies and knowledge is required not only in the field of academics but also in other felids too but it is especially required in law teacher to remain the most wanted and desirable person. He also gave practical pointers on how to become a ‘good teacher’. According to him, to become a ‘good teacher’ one must always motivate oneself to have a vision and shape this vision according to oneself. He pointed out, that for a teacher to teach law he/she must first understand the law as it is himself and then go about understanding from the case laws and judgments and only then he would be able to teach law to the students. He emphasized on the need for enhanced observation skills and research in order to develop and formulate a research problem. He greatly urged the faculty present to start writing and analyzing in order to utilize his or her potential as an academician to the fullest. He enlightened the faculty present on how to develop oneself into a better teacher and an academician.
Outcome of the event: The programme was quite informative and interactive. It was learning and motivating session for the participants as it has provided the exposure and made the participants aware with the research, methods of research and role of legal research in development of law.
DAY 2 (17.12.2019)
On this auspicious day, the special guest was Mr. Subhash Bhutoria(Advocate), who spoke about Issues in IPR (Intellectual Property Right). The seminar started with brief introduction by Dr Pallavi Gupta (Head of the Department) who welcomed our honorable chief guest and request to throw some light on how faculty can get more familiar with the IPR, and what is the subject all about. Further she also asked to tell what is the subject all about, as most of the faculties are not familiar with the subject.
The guest discussed about “The magic that is Intellectual Property Right” on which he gave a power point presentation. He discussed about the shape of good how it is used in the IPR. He gave a brief presentation on the common creative license.He also spoke about copyright as it is not a creativity. He further discussed through some light on “creativity” which is considered as essential in IPR.
In the power point slides he discussed about “Amortentia” in which he discussed about the Berne Convention, Paris Convention, Trips Agreement, Vienna Agreement etc. He also elaborated that Intellectual Property can be a pattern or a trademark or a secret.
He also put his views about the non-confidentiality. He also said that in India Copyright is a very confusing law. He gave an example of Kindle, the device is a patent software. He further spoke about the change which is essential in this IPR world, as IPR is the subject matter which is leading ahead of law. Further he spoke about the section 15 of the Copyright Act, 1957. He discussed about the copyright cannot subsist in the design matter as copyright will cease as soon as design subject matter is reproduced for more than fifty times by any industrial process by the owner or it licensee.
He also put his views onMotorrola case. That how technology has become more advanced. Further he talked about“WingardiumLeviosa” in which he discussed about the registered design which is protected for maximum of fifteen years.
Trade secret is also one the most important topic as it talks about undisclosed information in which he discussed and elaborated giving examples of various brands like KFC, COKE, BEHROJ BIRYANI how they have there trade secrets t make such kind of goods. Tarde secret is important which is not disclosed by the various companies depending on the nature of the product.
Last not the least he explained about the IP enforcement giving the example of the Chinese Water Torture Cell- Houdini, in which remedy and relief was discussed in the brief.
The participants who includes faculty, academicians questioned. Dr Pallavi mam asked about the patents, on which honorable guest discussed in brief about the patent.
Further Akansha Ghose mam asked about interface of IPR and Human Rights with regard to biodiversity, what is the IPR Fraternity evolving in the research. On which Mr Subhash discussed about the traditional knowledge giving an example of Banrasi silk, phulkari, turmeric etc.
Another question was raised by the MrsSishma Mam, with regard to the infringement of copyright, does the photocopying of book comes under infringement of copyright. He gave an example of various countries with regard to infringement as in USA person can buy music according to his or her tastes.
The programme ended by vote of thanks by Dr AmitaRathi, Dr Pallavi Gupta mam and Dr Ajay Tyagi sir by honoring the chief guest with the momento.

DAY 3 (18.12.2019)
On this auspicious day, the special guest was Mr. Ashok Singh (Manupatra), who gave a brief introduction about the Manupatra. He told about the manupatra how can we search and also gave a power point presentation. He further told about the segregation of laws and how research can be made with regard to bills, act, or cases or even articles, committee report.
The seminar started with brief introduction by Dr Pallavi Gupta (Head of the Department) who welcomed our honorable chief guest and request to throw some light on how to access manupatra.
The guest discussed about how search by be made by the legal words, year, by the name of the publisher also. He also discussed about the new feature that in judgment, if it is not possible to read the whole judgment then important paragraphs are marked on the left hand side.
The participants who includes faculty, academicians questioned. Mr Sudhir asked about the how to search for the judgment. He also asked about how the search can be made with regard to the evidence laws.
The guest also discussed about the other website of manupatra which is law skills, which is also proved to be beneficial in case of research.
Another question was raised by the Mr Rahul, with regard to the corporate training, and how it can be accessed.
The programme ended by Dr Pallavi Gupta mam by honoring the chief guest with the momento.
